Public sector employers must publish information on facility time, which is agreed time off from an individual’s job to carry out a trade union role by 31 July. The reporting period is the 12 months beginning 1 April each year, and any public sector employer that has had at least one trade union representative and 50 or more employees for seven months during that period must report. The Trade Union (Facility Time Publication Requirements) Regulations 2017 [1] ("the Regulations") require public sector employers to publish information relating to facility time taken by union representatives. These Regulations were laid following the enactment of the Trade Union Act 2016, which the Scottish Government strongly opposed throughout its passage.
